For Respondent : Mr.Antony Sahaya Prabahar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 411 of 2022 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120(B), 114 and 302 IPC in Crime No.411 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the Village Administrative Officer gave a complaint stating that he found a dead-body of one Suresh @ Sekar with injuries. On enquiry, it was found that the deceased person came to the first accused's house and questioned about the illicit relationship between his wife and the first accused. On the next day, the accused persons followed him and attacked him with lethal weapons, for which, he died. Hence, based on the complaint of the Village Administrative Officer, this case is registered.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and she has not committed any offence as alleged by the prosecution. Hence, she seeks anticipatory bail. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.14672 of 2022 4.The learned Additional Public Prosecutor would submit that totally two accused involved in this case and this petitioner is the second accused. He would further submit that in this case, the investigation is completed and charge sheet is also filed. However, considering the gravity of the offence, he strongly opposed to grant anticipatory bail to the petitioner.
5.Considering the facts and circumstances of the case and also considering the specific overt act as against the petitioner, this Court is not inclined to grant anticipatory bail. Hence, this Criminal Original Petition is dismissed.
