For Respondent : Mr.M.Muthumanikkam Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.109/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused Rank not known, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC read with Section 21(1) of Mines and Mineral (Development and Regulation) Act in Cr.No.109 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner has illegally transported 3/4 unit of river sand without proper permit. Hence the complaint.

prosecution. The petitioner is the owner of the vehicle and pray the petitioner to be released on anticipatory bail. 4.The learned Government Advocate(Crl.side) submitted that there are totally two accused in this case. The petitioner is the second accused. There are two previous cases are pending against this petitioner and and pray the petition to be dismissed. 5.Considering the facts and circumstances of this case, considering the nature of offence and also considering the number of cases pending against the petition, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this petition is dismissed.
