PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the entire records pertaining to the case in Crime No. 605 of 2017 on the file of the inspector of police, Srirangam police station, Trichy city and quash the same. O R D E R

This petition has been filed to quash the FIR in Crime No. 605 of 2017 on the file of the first respondent.

2.The learned Government Advocate (criminal side) submitted that the FIR in Crime No.605 of 2017 investigation has already been completed and the complaint has been closed as 'Mistake of Fact', thereafter, the first respondent also filed referred charge sheet before the concerned Magistrate. On receipt of the notice, the defacto complainant filed a protest petition. On the said protest petition the concerned Magistrate ordered further investigation in Crime No.605 of 2017. Therefore, the first respondent is keeping the FIR still pending.

Crl.O.P.(MD)No.905 of 2018 3.Considering the above circumstances, the petitioners are directed to submit all the documentary evidence before the first respondent. On receipt of the same, the first respondent is directed to consider and compete the investigation without influence of any of the observation made by the learned Magistrate within a period of two weeks from the date of receipt of a copy of this order. 4.With the above directions, this Criminal Original Petition is disposed of.
