PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to transfer the investigation in the case in Crime No.86 of 2016 on the file of the 3rd Respondent to 2nd Respondent and direct them to complete the investigation within the stipulated period.

O R D E R

This petition has been filed to transfer the investigation in Crime No.86 of 2016 on the file of the 3rd Respondent to the second respondent and direct them to complete the investigation within the stipulated period.

2.Heard both sides.

3.The learned Government Advocate (criminal side) would submit that initially the complaint has been registered by the Inspector of Police, Maraneri Police Station for the offence under Sections 397 https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.909 of 2018 and 302 of I.P.C, in Crime No.86 of 2016 and sofar they have examined more than 106 persons and did not fix the accused. Therefore, the case has been transferred, on the instruction of the first respondent, to the file of the third respondent. 4.Considering the above facts and circumstances of the case, this Court feels that the investigation to be monitored by the first respondent and the third respondent is directed to complete the investigation and file a final report within a period of three months from the date of receipt of a copy of this order. The first respondent is directed to monitor the investigation and ensure that the third respondent shall complete the investigation and file a final report as directed by this Court.

5.With the above direction, this Criminal Original Petition is disposed of.
