For Respondent : Mr.Kr.Bharathi Kannan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.190 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who is the sole Accused, apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 324 and 506(ii) of IPC, in Crime No.190 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that due to previous enmity, there was a wordy quarrel between the petitioner and the defacto complainant, in which, the petitioner said to have abused the defacto complainant by using filthy language and also assaulted him with Aruval and caused grievous injuries. Hence, the present complaint.
3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.
4.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that due to previous enmity, the petitioner has been falsely https://hcservices.ecourts.gov.in/hcservices/
implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioners.
5.The learned Government Advocate (Crl. Side), appearing for the respondent police submitted that due to previous enmity, there was a wordy quarrel between the petitioner and the defacto complainant, in which, the petitioner said to have abused the defacto complainant by using filthy language and also assaulted him with Aruval and caused grievous injuries and he was admitted in the Government Hospital and thereafter, he has been discharged from the hospital. Thereafter, he suffered same illness as such, again he was admitted in the Government Hospital for taking treatment. 6.Considering the facts and circumstances of the case and also considering the fact that the custodial interrogation of the petitioner is very much required, this Court is not inclined to grant anticipatory bail to the petitioner.
7.Accordingly, this Criminal Original Petition stands dismissed.
