O R D E R

The petitioner assails the order dated 04.05.2026 issued by the second respondent, whereby the approval of the appointment of the Secretary to the School and the School Committee nominated by the Educational Agency of the petitioner School has been rejected. 2.Heard Mr. K.K. Kannan, learned counsel for the petitioner, and Mr. S. Sivasubramaniam, learned Government Advocate for the respondent.

3.The facts of the case are that the Educational Agency of the petitioner School appointed a Secretary and nominated a School 2/6

Committee. Pursuant to a resolution passed by the Educational Agency, the third respondent recommended to the second respondent the approval of the School Committee and the appointment of the Secretary. Since the second respondent did not take any steps to approve the School Committee and the appointment of the Secretary, the petitioner was constrained to approach this Court in W.P.(MD) No.9492 of 2026. This Court, vide order dated 09.04.2026, directed the second respondent to consider the recommendation dated 02.04.2026 made by the third respondent on its own merits and pass appropriate orders in accordance with law. Pursuant to the directions issued by this Court, the second respondent rejected the request of the petitioner on the ground that the Educational Agency had not been approved by the second respondent. 4.

There is no provision in any enactment which prescribes that the School Committee and the President of the Educational Agency should be approved by the second respondent. Therefore, the rejection of the approval of the School Committee and the appointment of the Secretary to the petitioner School is arbitrary and discriminatory.

5.In view of the above, the writ petition stands allowed and the impugned order dated 04.05.2026 passed by the second respondent is hereby set aside. The second respondent is directed to approve the School Committee and the appointment of the Secretary as proposed by the third respondent. The said exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order. 6.There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
