PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 3 herein to permit the petitioner and remaining 71 tax payers of the temple to participate in the festival being conducted on 14.07.2023 at "Aruligu Chinnathambi" at Pallankulam, Gangaikondan, Tirunelveli District, on the basis of the petitioner's representation dated 09.07.2023.

O R D E R

This Writ Petition is filed seeking for a direction to the respondent Nos.1 to 3 to permit the petitioner and also remaining 71 tax payers to participate in the festival being conducted on 14.07.2023 at "Aruligu Chinnathambi" at Pallankulam, Gangaikondan, Tirunelveli District, on the basis of the representation dated 09.07.2023 by the petitioner and to consider the representation given by the petitioner dated 09.07.2023.

It is submitted by the learned counsel for the petitioner that in respect of the festival scheduled on 14.07.2023, the petitioner has approached the respondent Police and filed an application for permission to conduct festival and to provide adequate police protection by mentioning that the petitioner herein and the 71 tax payers shall not be permitted to participate in the proceedings and the respondent Police stated to have permitted the fourth respondent to conduct the festival by themselves alone, without participation of the petitioner and 71 tax payers. Aggrieved by the same, the present writ petition is filed.

3. Learned Government Advocate (Criminal Side) on the other hand submits that on the representation received from the fourth respondent, the police have advised the fourth respondent to conduct the festival peacefully. It 2/4

is represented by the learned counsel for the petitioner that the police have not specifically directed the fourth respondent to conduct the festival by all the villagers including the petitioner and 71 tax payers, which is the concern of the petitioner in this petition. Learned Government Advocate (Criminal Side) further submits that today the concerned jurisdictional Tahsildar is conducting a Peace Committee Meeting with all the groups of the village in respect of conducting of the programme / festival on 14.07.2023.

The petitioner, is therefore, directed to be present in the said meeting and place their grievances before the Tahsildar, The Tahsildar is directed to take into consideration the grievances of the petitioner and the other group persons and take appropriate decision for conducting the festival smoothly with the participation of all the villagers including the petitioner and the 71 tax payers.

5. With this direction, this Writ Petition stands disposed of. No costs.
