Whereby the petitioner has been convicted for the offence under Section 138 of Negotiable Instrument Act and sentenced him to undergo simple imprisonment for 6 months set aside the same by allowing the above criminal revision petition.

ORDER

This Criminal Revision has been filed to set aside the Judgment dated 05.12.2017 made in C.A.No.32 of 2016 on the file of the learned Additional District and Sessions Judge, (Fast Track Court), Kumbakonam confirming the conviction and sentence imposed by the learned Judicial Magistrate Fast Track Court No.II, Kumbakonam in S.T.C.No.4057 of 2009 dated 21.04.2016.

2.It is evident from the records that on earlier occasion i.e., on 24.03.2023 when the matter was called for hearing, no one appeared on behalf of the petitioner and hence, today, this matter was directed to be listed under the caption "For Dismissal". However, no one appeared on behalf of the petitioner today also.

3.In view of the same, this criminal revision case stands dismissed for non-prosecution.
