Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondents 2 and 3 to cancel the Patta issued in favour of the 4th respondent vide patta no.1142 in respect of the land in S.No. 10/2A Allinagaram Village, Thiruppuvanam Taluk, Sivagangai District and consequently restore the patta in the name of petitioners father Aathimulam's until the civil suit in O.S.No.50/2024 pending before the Learned District Munsif Cum Judicial Magistrate, Thiruppuvanam attains it finality by considering petitioner's representation dated 04.06.2026.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 2 and 3 to cancel the Patta issued in favour of the 4th respondent vide patta no.1142 in respect of the land in S.No. 10/2A Allinagaram Village, Thiruppuvanam Taluk, Sivagangai District and consequently restore the patta in the name of petitioners father Aathimulam's until the civil suit in O.S.No. 50/2024 pending before the Learned District Munsif Cum Judicial Magistrate, Thiruppuvanam attains it finality by considering petitioner's representation dated 04.06.2026.
2.The contention of the petitioner is that there is a rival claim between the siblings and a partition suit in O.S.No.50 of 2024 on the file of District Munsif cum Judicial Magistrate, Thiruppuvanam, is filed. However, now, the patta stands in the name of the 4th respondent. Aggrieved over the same, the petitioner is seeking to cancel the patta. When there is a title dispute, especially partition suit, it is always advisable better to keep the patta in the name of the original owner. The original owner is the father, namely Aathimulam. The petitioner is the son of Aathimulam. The 4th respondent is the wife of the petitioner's brother. 3.Therefore, this Court is directing the official respondents to consider and pass
orders after hearing the petitioner and the 3rd and 4th respondents. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. While passing the order the above observations shall be taken into account. 4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
