Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the representation dated 14.12.2020 to the third respondent which was recommended to the first respondent in Na.Ka.No.A3/782/2021 dated 10.12.2021 to refix the seniority and the petitioner's promotions including wages and other benefits in accordance with G.O.Ms.No.89, Personnel and Administrative Reforms (P) Department dated 28.07.2020, fixing the petitioner date of joining the services as from 15.07.1988 for the petitioner. 1/4

O R D E R

The instant writ petition has been filed by a Tahsildar seeking a mandamus directing the respondents to consider his representation dated 14.12.2020, and to refix the seniority and grant promotion and other monetary benefits based upon the G.O.Ms.No.89, Personnel and Administrative Reforms Department dated 28.07.2020.

2. The petitioner herein was initially appointed as a Steno-Typist on 15.07.1988. Due to want of vacancy, the petitioner was ousted from service on 22.07.1988. The petitioner and other similarly placed persons were directed to appear for a special examination for absorption into government service and accordingly they have appeared for examination on 24.06.1995. Based upon the results in the said examination, the petitioner was reappointed on 20.11.1997. The petitioner herein relies upon G.O.Ms.No.89, Personnel and Administrative Reforms Department, dated 28.07.2020, wherein, it is stated that, in case, if the candidates clear the special qualifying examination, 2/4

their services shall be regularized from the date of their initial appointment without reference to break in service caused due to the delay in passing order of reinstatement in service. Seeking the above said benefits, the petitioner has given a representation to the first respondent on 14.12.2020. Since the same has not been considered, the present writ petition has been filed.

Considering the above said facts, the first respondent is directed to consider the representation of the petitioner dated 14.12.2020 and 07.06.2023 in the light of G.O.Ms.No.89, Personnel and Administrative Reforms Department dated 28.07.2020, and pass orders in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above said observations, this writ petition is disposed of. No costs.
