ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 363, 120(B) IPC, in Crime No.22 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution in brief: The defacto complainant is a permanent resident of Sakin-Shivpur Kapur Diyar (Gaderia) Police Station, Dokati District, Baliya, Uttar Pradesh. On 22.01.2023 at about 11.00a.m., her daughter Dimpal Yadav, aged 15 years went to Lalganj Bazar to buy some materials and did not return to home. Later she came to know that one Rakesh Chaudhari seduced her daughter and taken her away to some other place. The other people also assisted the above said person to commit abduction. Later the daughter called her through phone in mobile No.9670392634, she was crying that her life is in danger. Therefore, she lodged the complaint and a case was registered against the accused persons.
3. Seeking interstate bail, this petition has been filed stating that he did not involve in above said occurrence. Only the defacto complainant fell in love with the petitioner. They got married and living separately at Tuticorin. Their marriage was registered before the Sub Registrar, Gajuwaka. He is working as a Indian Coast Guard, headquarters at No.16, Coast Guard District, Harbour Estate, Tuticorin. 2/3
4.Since the case was registered on the file of first respondent for abducting the minor child of the defacto complainant, this Court is not inclined to grant interstate bail to the petitioner. The petitioner has to approach the jurisdictional Court for appropriate relief.
