Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.A.MITHUN CHAKRAVARTHI, Advocate for the petitioner and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed on the petitioner in Crl.O.P.(MD) No.12151 of 2023 on 07.07.2023.
2.While passing the order, this Court has passed an order that the petitioner 1/3
shall deposit Rs.5,53,000/- to the credit of the Crime No.262 of 2023 before the trial Court concerned.
3. Now the grievance of the petitioner is that he is not in a position to mobilise the above said amount and deposit the same. Further he would submit that the coaccused have been enlarged on bail on condition to deposit Rs.50,000/- each.
4. The learned Government Advocate (Crl. Side) submitted that from this petitioner alone, the above said tobacco products seized. According to him, there is no necessity for reducing the amount. Further, he would submit that the petitioner is involved in previous case in similar nature, on that ground, the above said condition has been imposed upon the petitioner.
5. Considering the submission made by the learned Government Advocate (Crl. Side), I find no reason to interfere into the order passed by this Court in Crl.O.P. (MD) No.12151 of 2023 on 07.07.2023. Hence, this Criminal Miscellaneous Petition is dismissed.
