Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the respondent to disburse the amount of Rs.16,19,015/- which has been deducted from the petitioner's bill and the Earnest Money Deposit (EMD) made by the petitioner within the time frame fixed by this Court, by considering the petitioner's representation dated 17.10.2024.

ORDER

This Writ Petition is taken up for final disposal at the time of admission after hearing the learned counsel for the petitioner and the respondent.

2. The petitioner has approached this Court for Mandamus to direct the respondent to disburse the amount of Rs.16,19,015/-, which has been deducted from the petitioner's bill and the Earnest Money Deposit (EMD) made by the petitioner within the time frame fixed by this Court, by considering the petitioner's representation dated 17.10.2024.

3. It is informed that despite the fact that the petitioner has completed the work. It is submitted that the respondent has however not paid the amount and hence, the petitioner has sent a representation dated 17.10.2024 to the respondent.

4. Although the learned Standing Counsel for the respondent would submit that the petitioner had not maintained the time lines prescribed for completion of work and in view of the audit objections, payments have not been made, I am of the view that the petitioner's representation dated 17.10.2024 deserves a proper consideration so that the petitioner can work out the remedy

in case the amount claimed is rejected. In view of the same, there shall be a direction to the respondent to consider the petitioner's representation dated 17.10.2024 and pass order on merits within a period of four (4) weeks from the date of receipt of a copy of this order after hearing the petitioner.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
