Writ Petition filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorari, or any Writ or Order or Direction in the nature of Writ to call for the records pertaining to the impugned E-Auction Sale Notice dated 29.07.2022 No. Nil issued by the 1st respondent and quash the same as illegal.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. WMP(MD) No.13551 of 2022 [Order of the Court was made by S.S.SUNDAR, J.] This Court granted interim stay on 17.08.2022 for a period of four weeks on condition that the petitioner deposits a sum of Rs.20,00,000/- (Rupees Twenty Lakhs only) on or before 22.08.2022.
2. The learned counsel for the petitioner and the respondents submitted that the petitioner has complied with the condition and deposited a sum of Rs.20,00,000/- (Rupees Twenty Lakhs only) before the due date.
3. In the said circumstances, the interim order granted by this Court on 17.08.2022 is made absolute on condition that the petitioner deposits a sum of Rs.20,00,000/- (Rupees Twenty Lakhs only) on or before 22.09.2022, (ii) a further sum of Rs.40,00,000/- (Rupees Fourty Lakhs only) on or before 26.10.2022, (iii) a further sum of Rs.40,00,000/- (Rupees Fourty Lakhs only) on or before 23.11.2022 and (iv) a further sum of Rs.40,00,000/- (Rupees Fourty Lakhs only) on or before 22.12.2022 to the respondents. In case, the petitioner fails to deposit any one of the installments, the interim order granted by this Court shall stand vacated automatically without any further reference to this Court and it is open to the respondents to proceed further in accordance with law.
