For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 5 of 2019 on the file of the Respondent Police.
ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 406, 420, 465, 467, 468, 506(2) and 34 IPC in Crime No.5 of 2019. He seeks anticipatory bail.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent Police.
3.The petitioner is figuring as the second respondent in Crime No.5 of 2019 on the file of the District Crime Branch, Viruthunagar. The main allegation appears to be more against the first accused, who is none other than the father of the petitioner herein. The petitioner is now working as an IT professional at Chennai. 4.The petitioner's counsel undertakes that the petitioner would deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.5 of 2019 on the file of the respondent before the Judicial Magistrate No.II, Virudhunagar, within a period of four https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.11868 of 2019 weeks from the date of receipt of a copy of this order. The petitioner gives further undertaking that his father will surrender before the respondent on or before 16.09.2019. 5.Subject to this Condition, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Viruthunagar and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
