Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to comply with the orders passed on 06.11.2002 in W.P.No.37971 of 2002 of the Principal Bench of this Court and to disburse the compensation at Rs.1500/- per cent together with all the statutory benefits within a time limit to be stipulated by this Court.

ORDER

This writ petition is filed seeking a writ of mandamus to direct the respondent to comply with the orders dated 06.11.2002 passed in W.P.No.37971 of 2002 by the Principal Seat of this Court and to disburse the compensation at Rs.1,500/- per cent together with all the statutory benefits, within the time stipulated by this Court.

2.The case of the petitioner is that the land comprised in Survey No.185/5, Kooraikundu Village, Virudhunagar, belonging to the father of the petitioners, was acquired for providing quarters for Armed Reservemen and for Parade Ground and the Division Bench of this Court fixed the compensation at Rs.1,500/- per cent with all statutory benefits, in the appeals filed by the State. The father of the petitioners also filed W.P.No.37971 of 2002 before the Principal Seat of this Court, wherein the respondents therein were directed to pass appropriate orders in the light of the Judgment passed in the appeals filed by the State, after giving an opportunity of hearing to the father of the petitioners. Since, the respondent has not taken any action, the petitioners are before this Court.

3.Today, when the matter is taken up for hearing, the learned Government Advocate appearing for the respondent submitted that the representation of the father of petitioners has been rejected on the ground that he has not filed an application under Section 18 of the Land Acquisition Act for reference to the Court, vide proceedings, dated 21.02.2003. The learned Government Advocate has also served a copy of the said proceedings to the learned counsel for the petitioners.

4.Recording the same, writ petition is closed, leaving it open to the petitioners to challenge the said proceedings, dated 21.02.2003, if so advised. No costs.
