: Respondents PRAYER :- Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, to direct the 1st respondent to issue the passport in respect of petitioner application in File No.MD1073078941720 dated 02.11.2020 within a stipulated time prescribed by this Court.

ORDER

Heard the learned Counsel on either side.

2.The petitioner has applied for issuance of passport. The said application has been kept pending by citing the pendency of an FIR registered against the petitioner. It is well settled that mere registration of an FIR cannot be a ground for denying issuance of https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.18551 of 2020 passport. Therefore, I direct the first respondent to issue passport to the petitioner, if the petitioner is otherwise eligible. It is make it clear that mere registration of an FIR will not be a ground for denying the relief to the petitioner herein. The Writ Petition is allowed on these terms. No costs.
