The petition filed under Article 227 of the Constitution of India, to direct the learned Family Judge, Madurai to expedite the trial in H.M.O.P.No.524 of 2017 within a stipulated time as fixed by this Court. For Petitioner : Ms.P.Yasmin Begum

ORDER

This Civil Revision Petition is filed to issue a direction to the Family Court, Madurai to expedite the trial in H.M.O.P.No.524 of 2017 within a time frame.

2.The learned counsel appearing for the revision petitioner / husband would submit that the petitioner has filed H.M.O.P.No.524 of 2017 and the same is pending for more than 2 years. Further, referring to the Judicial Notification No.C-5 CAS/2007, Tamil Nadu (Case Flow Management in Subordinate Courts) Rules, 2007, the learned counsel contended that H.M.O.P. would be disposed of within a period of 12 months. Hence, the petitioner is before this Court with the present Civil Revision Petition for issuance of a direction to the Court below for the disposal of H.M.O.P. at the earliest point of time.

3.Considering the facts and circumstances of this case and in view of the Judicial Notification and also the submission made by the learned counsel appearing for the petitioner the H.M.O.P. would be disposed of within a period of one year from the date of filing, however, the same is pending for more than 2 years. Therefore, this Court is inclined to issue direction to the Court below to dispose of the H.M.O.P. within a time frame.

4.Accordingly, the Family Court, Madurai is hereby directed to dispose of the H.M.O.P.No.524 of 2017 within a period of 3 months from the date of receipt of a copy of this order.
