PRAYER :- For Bail in Crime No.318 of 2015 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 15.03.2023 for the offence punishable under Sections 366 (A) of IPC and section 5 1/4

(l) r/w.6 of POCSO Act in Crime No.318 of 2015 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner under the pretext of love had committed penetrative sexual assault on the victim , hence the case.

3. Heard both sides and perused the materials available on record including the First Information Report and also the statement of the victim recorded under section 164 of Cr.P.C.

4. Originally the petitioner was arrested and remanded to judicial custody. Later he was released on bail and thereafter, he was absconding. So, warrant was also issued by the concerned Court, he was secured and remanded to judicial custody on 15.03.2023 till date. The earlier bail application that was filed by this petitioner was dismissed by this Court in Crl.O.P(MD) No.11634 of 2023.

5. It is submitted by the prosecution that three witnesses were already examined and over examination of witnesses, direction was issued to the concerned Special Court, dated 30.06.2023 to complete the process of investigation within a period of two months. But not satisfying the above said order, this petition has been moved again by this petitioner.

6. The petitioner is directed to co-operate with the trial Court to complete the process of investigation as already directed by this Court on 30.06.2023. I find no 2/4

reason to entertain this petition at this stage. Hence, this Criminal Original Petition is dismissed.
