ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 324, 506(ii) IPC, 1/3
in Crime No.126 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 04.07.2023, the accused persons quarrelled with the defacto complainant and his friend and abused them with filthy language and also assaulted them with bottles. The accused persons also threatened them with dire consequences. Hence, the complaint. 3.The learned counsel for the petitioner submitted that he is innocent and not committed any offence, as alleged by the prosecution. In this case, the injured has been discharged from the hospital. Hence, prays to release him on anticipatory bail. 4.The learned Government Advocate (Crl.Side) submitted that though the injured has been discharged from the hospital, the petitioner is having four previous cases to his credit. In which, he was convicted in Crime No.7 of 2009 and paid fine and in other three cases, two were registered for the offence of criminal intimidation. Hence, prayed to dismiss the petition.
5.Heard the learned counsel appearing on either side and perused the materials placed before this Court.
6.Considering the nature of the case and considering the bad antecedents of the petitioner, he seems to be a habitual offender. Hence, this Court is not inclined to grant anticipatory bail to him.
