ORDER : The Court made the following order :- The petitioners/ Accused herein, who were arrested for the alleged offence under Sections 147, 148, 294(b), 323, 506(2) and Section 4 of TNPPDL Act, in Crime No.164 of 2022 on the file of the respondent police, seek bail.
2.The case of the prosecution is that due to quarrel arose at the time of driving vehicle, the petitioners and other accused said to have attacked the defacto complainant and caused damage to the vehicle. Hence, the case.
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Crl. Side) submitted that the damage caused by the petitioners is worth Rs.5,000/- and the coaccused have already been released on anticipatory bail in Crl.O.P https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.14753 of 2022 (MD).No.14457 of 2022 and in Crl.M.P.No.1469 of 2022 respectively and the investigation of the case is pending. 5.Considering the period of incarceration and that the coaccused have already been granted bail by this Court, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Aravakurichi and on further condition that petitioners shall deposit a sum of Rs.5,000/- (Rupees Five Thousand only) each to the credit of Crime No.164 of 2022 and the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
