Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents herein to fix the seniority of the petitioner as Sub Inspector of Police in the 2006 Selection on par with his other batch-mates as per the marks obtained in the direct recruitment to be reckoned from 2008 as per the orders of the Ist respondent in G.O.Ms.No.376 Home (Police-III) Department dated 4.5.2015 and consequently direct the respondents herein to post the petitioner as Sub Inspector of Police in the Taluk Police Station in accordance with the service rules on par with other similarly placed juniors to the petitioners.

ORDER

The petitioner has come up with the above writ petition seeking for the issue of a writ of mandamus, to direct the respondents to fix the seniority of the petitioner as Sub Inspector of Police in the 2006 selection on par with his other batchmates as per the marks obtained in the direct recruitment to be reckoned from 2008 as per the orders of the first respondent in G.O.Ms.No.376 Home (Police-III) Department, dated 4.5.2015 and consequently direct the respondents to post the petitioner as Sub Inspector of Police in the Taluk Police Station in accordance with the service rules on par with other similarly placed juniors to the petitioner.

2.Heard the learned counsel for the petitioner. Mr.S.Chandrasekar, learned Government Advocate takes notice for the respondents.

3.It is seen that the petitioner has already made a representation on 10.12.2015 before the second respondent seeking for the very same relief. It is further stated that the said representation is still pending.

4.Considering the above stated facts and circumstances and without expressing any view on the claim made by the petitioner, the writ petition is disposed of directing the second respondent to consider the representation of the petitioner dated 10.12.2015 and pass orders on the same, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, W.M.P(MD)Nos.4236 and 4237 of 2016 are closed.
