ORDER : The Court made the following order :- The petitioner / A5, who was arrested and remanded to judicial custody on 17.04.2026 for the offences punishable under Sections 194 BNS 1/5

@ 103(1) of BNS @ 191(2), 191(3), 103(2), 61(2), 238 of BNS in Crime No. 226 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that a decomposed male body was noticed in the water bed of Thamirabarani River on 07.45 p.m., by somebody who informed later to the VAO of Karupandurai Village. The same was removed from the river by the fire service personals. The VAO lodged complaint to the respondent police and the case has been registered under Section 194 of BNSS, The dead body was later identified as one Arockiyara of the same village who belongs to a particular community. The Hence the case.

3. The learned counsel for the petitioner would submit that the respondent police has registered a false case against the petitioner and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been arrested and remanded to judicial custody on 17.04.2026. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate(Crl.Side) appearing for the respondent would submit that it is a case of murder and all the accused 2/5

persons brutally murdered the deceased and put the body of the deceased is the river. He would further submit that investigation is pending. Hence, he opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel on either side and considering the nature of offences and also taking into consideration the gravity of offences and the fact that investigation is not yet completed this Court is not inclined to grant bail to the petitioner.

7. Hence the petition stands dismissed.
