5.P.Palchamy : Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari to call for the records pertaining to the orders passed by the 1st respondent in KV3/334/2022 dated 06.07.2022 and quash the same and consequently direct the 5th respondent to stop illegal quarrying obliviously which is carried out under the guise of leveling the land from the patta lands pertaining to the 5th respondent, comprised in S.No.333/5, 334/5, 342/7, 343/5 admeasuring 1.69.00 Hectares, situated at P.Vahaikulam Village along the banks of "Kirudhumal River" running through the Virudhunagar District. ORDER
(Order of the Court was made by P.N.PRAKASH, J.) Alleging that the 5th respondent carrying on the quarry operations in violation of the quarry license conditions, the present public interest litigation has been filed to quash the quarry license dated 06.07.2022.
2. Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents 1 to 4. 2/5
3.On instructions, the learned Government Pleader submitted that the District Revenue Officer, Deputy Superintendent of Police, Assistant Director (Mines and Minerals) and the Tahsildar have conducted a joint inspection in the presence of the petitioner and a report dated 12.08.2022 has been submitted by the said revenue officials to the District Collector alleging that the 5th respondent has used heavy machineries for quarrying. Based on the said report, the District Collector issued a show cause notice dated 13.08.2022 to the 5th respondent calling for his explanation, for which, the 5th respondent appeared to have given his explanation dated 16.08.2022 and the said explanation is under consideration of the District Collector, Virudhunagar. Recording the same, this petition is closed. No costs. Consequently connected Miscellaneous Petitions are closed.
