O R D E R
This petition has been filed seeking direction to the respondents 1 to 3 to issue adequate police protection, to the life and limb of the petitioner and his wife from the respondents 4 to 7, in the light of the petitioner's representation, dated 22.09.2021. 2.The case of the petitioner is that on 29.08.2021, six persons including the private respondents tress passed into the house of the petitioner and caused damages to the vehicles as well as the house 1/3
hold articles, they also brutally attacked the petitioner and his wife and committed robbery of 12 soverigns of gold jewels and Rs.5 lakhs cash. Based upon the complaint given by the petitioner a case has been registered in Cr.No.142 of 2021, but not under the provisions of IPC. Therefore, he made a representation on 22.09.2021 to alter the FIR. They have also filed petition seeking anticipatory bail in Crl.M.P.No.4255 of 2021 before the learned Principal District Judge, Madurai and that was dismissed on 21.09.2021. Even after dismissing the application, on 21.09.2021 at night the respondents 4 and 7 came to the hospital Thirumangalam, where the petitioner and his wife was taking treatment, threatened to withdraw the complaint. Therefore, another complaint was made on 22.09.2021. But, there is no progress. The counter complaint given by the private respondents against the petitioners came to be closed on 19.09.2021 as mistake of fact.
3.The learned Additional Public Prosecutor submitted that frequent surveillance has been made earlier by the police department.
4.However, since representation is pending, the same may be considered on merits by summoning the petitioner as well as the private respondents, within a period of one month from the date of receipt of a copy of this order.
5.With the above directions, this criminal original petition is disposed of.
