Respondent/Complainant For Petitioners : M/s.K.Myilvaganan, Advocate For Respondent : M/s.R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.41 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order : Alleging harassment and demand of dowry, the defacto complainant has lodged a complaint as against the petitioners and other accused, which was registered by the respondent police in Crime No.41 of 2021 for the offence under Sections 498(A) and 406 IPC. Apprehending arrest in the said case, the petitioners have moved the instant criminal original petition for anticipatory bail. 2.When the matter came up for hearing in the earlier occasion, learned Counsel for the petitioners submitted that the petitioners

are innocents and have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are ready to co-operate for the investigation.

3.In view of the aforesaid submission made by the learned Counsel for the petitioners, this Court has granted interim anticipatory bail to the petitioners and directed them to appear before the respondent police and to co-operate for the enquiry. The respondent police was, in turn, directed to refer the parties to the Social Welfare Officer concerned so as to find out the possibility of arriving any solution between the parties. 4.Today, learned Government Advocate (Crl. Side), on instructions, submitted that the petitioners neither co-operated for the enquiry before the respondent police nor cooperated for the counselling before the District Social Welfare Officer.

5.In view of the conduct of the petitioners in obtaining an interim order by submitting that they would co-operate for the investigation and thereafter, not complying the same, this Court is not inclined to entertain this application.

Accordingly, this application for anticipatory bail stands dismissed.
