Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order Nil dated Nil issued by the second respondent and quash the same as illegal and consequently direct the second respondent to issue Legal Heir Certificate of Aathimoolam Pillai, S/o. Duraisamy Pillai by including the name of 1) Chellammal and her daughter 2) Azhagiya Meenal, within the stipulated time fixed by this Court. 1/5

Mr.D.Ghandiraj, learned Special Government Pleader takes notice for the respondents.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

3. The petitioner claims to be the daughter of one Aadhimoolam Pillai, who died on 04.07.1974. It appears that the petitioner's father late Aadhimoolam Pillai had a first wife, namely Chellammal, through whom a daughter, namely, Azhagiya Meenal was born. The first respondent has rejected the request of the petitioner for issuance of a fresh legal heirship certificate by including the name of Chellammal and Azhagiya Meenal. The reasons forthwith coming in the impugned communication are that there are other legal heirs of Aadhimoolam Pillai through his second wife, namely 2/5

Sundarammal. The petitioner is claiming Clause I legal heirship Certificate and therefore, the enquiry is confined only to the clause I legal heirs of the deceased Aadhimoolam Pillai.

Considering the same, there shall be a direction to the respondents to redo the exercise and to issue fresh legal heir certificate by including the name of Chellammal and Azhagiya Meenal after enquiry. This exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 03.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No sn 3/5
