This petition has been filed seeking a direction to the 2nd respondent to not to harass the petitioner and his family members under the guise of enquiry without due process of law. 2.The case of the petitioner is that the petitioner's brothers namely Sundaramoorthy, one Gowarathan and one Dheenadayalan jointly promoted a business in the year 1995 in the name style of RoyalLands Promoters.
A monthly instalments scheme was introduced. The third respondent joined in the scheme 1995-1997. Because of the above said business transaction, dispute arose. The 1/3
third respondent has appears to have given a complaint continuously. The earlier complaint given by the third respondent was closed. The third respondent has given a complaint in CSR.No.93 of 2020, dated 18.03.2020 and the same was closed on 19.03.2020 based upon the undertaking given by the third respondent. In spite of the Closure Report of the above said complaint, again the third respondent given a complaint to the second respondent.
Now the second respondent is making harassment.
3.The learned Additional Public Prosecutor submitted that based upon the complaint enquiry has been undertaken in CSR.No.472of 2021 and by advising the parties to workout their remedy through appropriate proceedings, closed the complaint. 4.Since the complaint has been closed, nothing survives for further consideration and direction in this case, since the harassment may not exists.
5.Recording the submission of the learned Additional Public Prosecutor and in view of the closure report, this criminal original petition is disposed of as infructuous.
