Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to grant necessary permission and give adequate police protection to MINOLI KABAADI COMPETITION with usage of speaker boxes scheduled to be held on 25.03.2016 at 10.00 pm to 26.03.2016 at 10.00 am at A.P Nagar ground situated in the rear side of Nadar Valibar Sangam Puliyankudi on the eve of Ester festival.

O R D E R

This writ petition has been filed for a direction, directing the respondents to grant permission and accord protection for conducting the Monali Kabaadi Competition, scheduled to be held at A.P Nagar Ground situated in the rear side of Nadar Valibar Sangam Puliyankudi on the eve of Ester festival, from 10.00 a.m., on 25.03.2016 till 10.00 a.m., on 26.03.2016.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

3. This Court is aware of the fact that the Election Commission of India has announced time table for elections to the State Assembly and therefore, the Police will be under much strain. Under such circumstances, it will not be advisable to grant permission for such programmes, if there are going to be any law and order problem

4. Without going into the merits of the case, the 2nd respondent is directed to consider the representation of the petitioner taking into consideration the antecedents of the petitioner and his capacity to conduct the tournament and all other factors including communal and law and order factors and dispose the same on merits and in accordance with law, expeditiously, preferably on or before 25.03.2016. the authorities deciding to give permission, the same should be given during day time and it should include the conditions imposed by this Court in W.P.(MD) No.1474 of 2016 dated 22.01.2016. No costs. Sd/- Assistant Registrar(RTI) /True Copy/ Sub Assistant Registrar(CS) Note:
