ORDER
The Writ Petition has been filed, invoking Article 226 of the 1/4
Constitution of India, seeking orders to direct the first respondent to transfer the investigation on writ petitioner's complaint dated 28.11.2022 to some other investigation agency by considering the writ petitioner's representation dated 17.01.2024.
2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents would submit that the writ petitioner has earlier given a representation dated 28.11.2022 and again on 17.01.2024 and at the time of enquiry, both the parties have entered into a settlement and on that basis, the same were ordered to be closed. Moreover, the very prayer itself cannot be sustained and if the writ petitioner is of the view that the police has not taken any action, it is open to the writ petitioner to invoke Section 156(3) Cr.P.C. or 200 Cr.P.C. and as such, the present petition itself is not maintainable.
