ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 29.02.2024 for the offences punishable under Sections 8 (c ), 20(b) (ii) (C) 25 and 29 (1) of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.68 of 2024, on the file of the respondent police, seeks bail.

The case of the prosecution is that on 28.02.2024 at about 23.30 hours, the Sub Inspector of Police received a secret information about the drug trafficking at Sillampatti - B.Kamatchipuram Road, Keeripatti Junction Road and based on the said information, the respondent police went to the spot and they found a Car and Container Lorry, nearby to the vehicle they found two persons and they were apprehended, after complying the procedure under Section 50 of NDPS Act and they recovered 40 Kgs of Ganja from the container lorry. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any of the offence alleged by the prosecution. He further submitted that the petitioner is in jail from 29.02.2024. Therefore, he seeks to grant bail to the petitioner. 2/5

4. The learned Additional Public Prosecutor submitted that this is the third bail petition. He further submitted that the petitioner had earlier filed a bail petition in Crl.O.P.(MD)No. 13728 of 2024 before this Court and the same was dismissed on 21.08.2024 and thereafter, the second bail application filed by the petitioner in Crl.O.P(MD) No.16612 of 2024 was also dismissed by this Court on 01.10.2024. He further submitted that the petitioner and the 2nd accused had procured the contraband from Andhra Pradesh and the car in which the contraband was being smuggled also belonged to the petitioner. He further submitted that the petitioner has not satisfied the requirements under Section 37 of the NDPS Act. Hence, he strongly objected to grant bail to the petitioner.

5. Considering the gravity of the offence and the quantity of Ganja and also considering the fact that the petitioner has failed to satisfy the requirements under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.
