PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to consider the petitioner's reminder representation dated 07.07.2020 and 08.12.2020 respectively and to direct the respondents No.1 to 4 to take necessary action and to upload the petitioner's name in the Computer patta No.237 as capacity of tenant in respect of Survey number Survey Number 451/3 to an extent of 0.93 Hectares and 454/2A to an extent of 0.3 Hectares, 454/2B to an extent of 0.95 and 454/1 to an extent of 0.25 Hectares at Keelazha Kadayam Village, Kadayam, Tenkasi Taluk, Tenkasi District (formally which come under Ambasamudram Taluk, Tirunelveli District).

O R D E R

This Writ Petition has been filed for the issue of writ of mandamus directing the fourth respondent to consider the representation made by the petitioner, wherein, the petitioner has sought for issuance of 2/5

patta with respect to the subject property in his capacity as a cultivating tenant.

2. Heard the learned counsel appearing for the petitioner as well as the learned Additional Government Pleader appearing for respondent Nos.1 to 6 and the learned counsel appearing for respondent Nos.7 and 8.

3. Taking into consideration the facts and circumstance of the case and without going into the merits of the case, there shall be a direction to the petitioner to make a fresh representation to the fourth respondent along with all the relevant documents and also a copy of this order. On receipt of the same, the fourth respondent shall call all the interested parties for enquiry and after hearing them, a final decision shall be taken on its own merits and in accordance with law and appropriate orders shall be passed. This process shall be completed within a period of eight (8) weeks from the date of receipt of the representation from the petitioner. 3/5

4. This Writ Petition is disposed of with the above directions. No costs.
