O R D E R

Heard the learned counsel appearing for the petitioner at length.

2. Admittedly, the petitioner herein, who was appointed as Senior Inspector of Cooperative Societies, joined the service on 04.05.2020. In terms of Section 31 of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, the petitioner is required to pass the departmental examinations during the period of probation i.e. two years and the said two years period is extendable upto a maximum period of five years. In case if the petitioner failed to pass the departmental examinations within the maximum period of five years, the respondents have no other option, except to pass appropriate orders under Sub Sections (3) & (4) of Section 31 of the said Act. In the present case, the petitioner, having joined the service on 04.05.2020, stated to have passed the requisite departmental examinations only on 27.05.2025 i.e., the last date of the departmental examinations, which is admittedly 2/5

beyond the period of five years from the date of joining of the petitioner in service. Hence, this Court is not inclined to pass any interim order either suspending or staying the operation of the impugned order, for the reason that the respondent has strictly acted in terms of Sections 31(3) and 31(4) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, and has terminated the probation of the petitioner.

3. Once it is concluded that the respondents have strictly followed the provisions of the Act governing the field, this Court does not find any reason to interfere with the impugned order at this interlocutory stage.
