PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the Special Court for SC/ST POA Act Cases, Theni, to consider the bail application of the petitioners on the same day of surrender in Cr.No.0304/2026 on the file of the 2nd respondent police.

ORDER

The present petition has been filed by the accused Nos.1 & 2, in crime No.304 of 2026, on the file of the second respondent police seeking a direction as against the trial Court to accept the surrender and consider the bail application of the petitioners on the same day of surrender.

2. Considering the averments in the petition, there shall be a direction to the Special Court for SC/ST POA Act Cases, Theni, to accept the surrender and consider the bail application of the petitioners on the same day of surrender in crime No.304 of 2026, after giving due opportunity to the defacto complainant.

3. The petitioners shall surrender before the concerned Court on or before 02.07.2026.

4. With the above said observations, this Criminal Original Petition stands allowed.
