O R D E R
The petitioner has lodged a complaint as against her in-laws that when she was in her parental home for the purpose of delivering the baby, her husband was murdered. She claims that there were injuries on the body of the petitioner's husband. However, the case was projected as if he has committed suicide. The petitioner has lodged a complaint before the Gandamanur Police Station and the same was registered in Crime No.177 of 2021, on 29.09.2021, for the offence under Sections 176, 498(A) and 506(i) IPC. The petitioner with a grievance that the respondent police has not conducted the investigation, has filed this petition, seeking direction to the respondent police to file the final report within a stipulated time. 2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the respondents, on instructions provided to him by the Sub Inspector of Police, submits that the investigation in Crime No.177 of 2021, has almost completed and they require four more weeks for filing the final report. 2/6
3.This Court considered the rival submissions made and also perused the materials placed on record.
4.It appears that for the case, which has been registered under Section 176, 498(A) and 506(i) IPC, the respondent police have taken four years for concluding the investigation and that too, on the application filed by this petitioner, now the respondent police is taking a stand that they would complete the investigation within a period of four weeks. The complaint reveals that her husband was assaulted by somebody and that has been recorded as that of suicide. When this Court verified with the Sub Inspector of Police as to the postmortem certificate, the Sub Inspector of police, who is present before this Court submits that the complaint itself has been lodged only after the cremation of the petitioner's husband's body. The petitioner in her complaint has made specific averment that when she was about to lodge a complaint, her husband's body was cremated. The investigation has been conducted in a lethargic manner. Therefore, this Court feels that the Inspector of police, Gandamanur Police Station has not conducted the investigation in Crime No.177 of 2021 properly. 3/6
5.In view of the above, this Court directs the Superintendent of Police, Theni/the first respondent herein, to transfer the case in Crime No.177 of 2021, dated 29.09.2021, which is pending on the file of the Gandamanur Police Station to any other sincere investigating officer and ensure that a proper investigation is conducted in this case. The Superintendent of Police is also expected to verify the manner in which, the investigation has been conducted so far in this case.
6.With the above directions, this Criminal Original Petition is disposed of.
