Respondents Prayer :Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, directing respondent Nos.1 and 2 to produce the person or body of the petitioner's daughter, namely, M.Sujitha d/o Murugan, aged about 24 years, before this Court and set her at liberty.

ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the first and second respondents to produce the body or person of the petitioner's daughter and to set her at liberty.

2. Heard the learned counsel on either side.

3. The grievance of the petitioner is that the petitioner's daughter, who was residing in Chennai, reached the residence on 08.05.2026 and she was staying with the family for some time. On 13.05.2026, the petitioner's daughter left to Chennai and thereafter, the whereabouts of the detenue was not able to be ascertained. Under such circumstances, a complaint came to be given before the second respondent, based on which, a woman missing FIR came to be registered in Crime No.415 of 2026 on 20.05.2026. Since

no effective steps were taken to find the whereabouts of the detenue, the present petition has been filed before this Court.

4. The learned counsel for the State of Tamil Nadu (Criminal Side) on instructions submitted that the detenue went along with one Kowsalya to Coimbatore and she is living with the said Kowsalya. He further submitted that steps are being taken to find the whereabouts of the detenue and to record the statement of the detenue.

5. Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel for the State of Tamil Nadu (Criminal Side), there shall be a direction to the second respondent to find the whereabouts of the detenue and produce her before the learned Judicial Magistrate, Ambasamudram. The statement of the detenue shall be recorded by the learned Judicial Magistrate and the learned Judicial Magistrate shall proceed further in accordance with law.
