ORDER

This writ petition is filed to call for the records pertaining to the impugned order issued by 2nd respondent vide information notice dated 19.03.2026 and quash the same as illegal, improper, unlawful, unconstitutional and arbitrary and consequently direct the 2nd respondent to trace out the missing original sale deed bearing registered document no.1633 of 1988 registered on the file of Sub Registrar, Thallakulam, Madurai and entrust the same to the petitioner or to issue non traceable certificate in respect of the property comprising in Survey No.5/8 plot no, 24 Eastern Portion and extent of 5 cents (2180 s.ft) situated at Parasurampatti Village, Thallakulam Sub Registry District, Madurai Taluk and Madurai District based on the representation 02.04.2026.

The learned counsel for the petitioner submitted that the petitioner's sale deed bearing registered Document No.1633 of 1988 registered on the file of Sub Registrar, Thallakulam, Madurai was lost and misplaced. In this regard, the petitioner has lodged a complaint and C.S.R.No.16 of 2024 has been issued. Pursuant to which, the same has been closed. Challenging the same, the petitioner is before this Court.

The learned Government Advocate(crl.side) submitted that the Director General of Police had already issued Circular Memorandum, dated 01.04.2022 in this regard with respect to issuance of NOC, where the applicants have to produce certain documents. Due to the non-cooperation of the petitioner, the complaint was closed.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. The petitioner has given a complaint dated 09.01.2024. The petitioner is further directed to produce all the necessary documents as required by the respondent police in terms of the Circular Memorandum, which is extracted below:

6. The respondent police is directed to reopen the case and the petitioner is directed to submit all the necessary documents as stated supra and extent fullest cooperation for the enquiry. On production of the above said documents as required in the Circular Memorandum extracted supra, the respondent police is directed to take necessary steps for issuance of Lost Document Report to the petitioner with respect to the sale deed bearing registered Document No.1633 of 1988 registered on the file of Sub Registrar, Thallakulam, Madurai.

7. With the above directions, this Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. 23.06.2026 NCC : Yes / No Index : Yes / No gbg To :
