ORDER : The Court made the following order :- The petitioners/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 406 and 420 IPC in Crime No.Not Known of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the defacto complainant has leased out 1/3
his two tipper lorries to the petitioners in November, 2021 on an oral agreement that the petitioners have to pay Rs.50,000/- per month. Since the petitioners have not paid any money, a complaint has been registered.
3. The learned Additional Public Prosecutor would submit a complaint has been given by the complainant stating that he lease out his two tipper lorries to the petitioner on lease basis. But the petitioners neither paid the lease amount nor returned the vehicle. On that basis, a complaint has been given by the defacto complainant and the same was numbered as CSR No.143 of 2023.
4. Let the complaint be enquired and completed within a period of fifteen days from the date of receipt of a copy of this order. The petitioners are directed to appear before the respondent and co-operate for enquiry and during the course of enquiry, if any trouble arises, the petitioners can workout remedy through appropriate proceedings.
