PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents to trace out and find out the Gift Settlement Deed dated 13.08.2012, registered as Document No. 1359 of 2012 Sub Registrar Office at Senkottai in favour of the petitioner which was lost on 07.04.2023 in Friday market or to issue Non Traceable Certificate in case the same is not found as per the guidelines issued by the first respondent in this regard vide his circular in RC.No.2029209/General.1(1)2022, dated 01.04.2022.

This Writ Petition is filed seeking for a direction to the respondent to issue non-traceable certificate to the petitioner in respect of the original sale deed bearing Document No.1359 of 2012 on the file of the Sub Registrar Office, Senkottai.

2. It is submitted by learned counsel for the petitioner that the petitioner has lost original document bearing Document No.1359 of 2012 and on which, in order to get a photocopy of the document from the concerned Sub Registrar Office, the petitioner has filed an application dated 29.05.2023 before the respondent Police to issue non traceable certificate and the said petition is pending.

3. Learned Government Advocate (Criminal Side) submitted that incase, if the petitioner is directed to appear before the police concerned, the police will dispose of this application and provide necessary certificate after following the requirements in respect of issuance of non-traceable certificate as directed in the guidelines issued by the Director General of Police/Head of Police Force, Chennai-4, dated 01.04.2022.

4. In view of the above, this Writ Petition is disposed of by directing the petitioner to appear before the concerned police and complete the formalities. On which, the respondent police are directed to issue necessary directions as expeditiously as possible.
