Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.850 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Accused Rank Not Known, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Section 379 IPC, in Crime No.850 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant on 19.06.2023, he 1/4

tied his cow in front of his house, next day morning at about 4.00 a.m., he found that his cow is missing, thereafter he searched and he could not found his cow. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and has not committed any such offences as stated by the prosecution. The cow is also recovered by the respondent Police.

4. The learned Additional Public Prosecutor would submit that the property has been recovered from the co-accused and on the basis of the confession statement of co-accused, this petitioner has been implicated in this case. The petitioner is having seven previous cases including NDPS Act case, roberry, theft and 307 IPC cases.

5. Considering the facts and circumstances of this case and considering the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this anticipatory bail petition deserves dismissal and accordingly dismissed.
