Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 2nd Respondent to consider the petitioner's representation, dated 02.05.2025, and cancel the patta granted to the 4th respondent in Patta No.848 for S.No.334/4 and Patta

No.649 for S.No.334/7 situated at Perumpacherri Village Group, Ilayangudi Taluk, Sivagangai District, and retrieve the land from the 4th respondent. For Petitioner :

ORDER

The petitioner herein seeks a direction to the second respondent to consider his representation, dated 02.05.2025, seeking cancellation of patta issued in favour of the fourth respondent in Patta No.848 in respect of the land situated in Survey No.334/4 and Patta No.649 in respect of the land situated in Survey No.334/7 in Perumpacherri Village Group, Ilayangudi Taluk, Sivagangai District.

2. According to the petitioner, the subject property has been used by him as an access to his property, which is situated in adjacent plot. The subject property had been assigned in favour of the fourth respondent without following relevant rules. The fourth respondent owns a terrace house with value of Rs.30.00 lakhs and is not eligible to get free assignment patta. Therefore, the petitioner submitted a representation on 02.05.2025 before the second respondent, seeking cancellation of assignment patta issued in favour

of the fourth respondent. The same has not been considered. Hence, the petitioner has come before this Court.

3. Government Advocate, appearing for respondents 1 to 3, would submit that the representation submitted by the petitioner will be considered by the second respondent in accordance with law, within a time stipulated by this Court.

4. In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the representation submitted by the petitioner, dated 02.05.2025, and pass final orders on its own merits within a period of twelve weeks from the date of receipt of copy of this order, after affording reasonable opportunity to the petitioner and the fourth respondent.

5. Accordingly, the Writ Petition stands disposed of. No costs. 07.07.2025 NCC :
