Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents to dispose the petitioner's appeal dated 19.05.2018 pending before the first respondent within the time stipulated by this Court. ORDER

The prayer in this writ petition is for a Writ of Mandamus, to direct the respondents to dispose the petitioner's appeal, dated 19.05.2018 pending before the first respondent, within a time frame to be stipulated by this Court.

2.Heard Mr.S.I.Muthiah, learned counsel appearing for the petitioner and Mr.B.Bhagawathi, learned Government Advocate appearing for the respondents.

3.With the consent of both sides, this writ petition is being disposed of at the admissions stage itself.

4.In order to rectify the mistake crept in the revenue records in respect of the property at Survey Nos.290, 293, 295/2, the petitioner preferred an appeal to the first respondent on 19.05.2018 and on receipt of the same, the first respondent directed the second respondent vide his letter in x.K.b3/10545/2018, dated 29.05.2018, to send a report. However, it is not known to the petitioner whether the second respondent send a report and at any rate since the appeal pending before the first respondent from 2018 has not https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.18692 of 2019 been decided sofar, the petitioner is before this Court. In this regard, the learned counsel for the petitioner submits that, if the suitable direction is given to decide the appeal pending before the first respondent on merits, within a time frame, the petitioner would be satisfied.

5.I have heard Mr.B.Bhagawathi, learned Government Advocate appearing for the respondents, who would submit that, as directed by the first respondent, the second respondent would send report, within a period of four weeks and thereafter, let the appeal be decided by the first respondent, within a time frame to be stipulated by this Court.

6.Considering the said submissions made by both sides, this Court is inclined to dispose of this writ petition, with the following directions:- "that the second respondent is hereby directed to send a report, as sought for by the first respondent vide his communication dated 29.05.2018, within a period of four weeks from the date of receipt of a copy of this order. On receipt of such report, the first respondent shall decide the appeal dated 19.05.2019 filed by the petitioner,on merits and in accordance with law, within a period of four weeks, thereafter."

7.With the above directions, this Writ Petition is disposed of. No costs.
