PRAYER :- Civil Revision Petition filed under Article 227 of Constitution of India, to set aside the docket order dated 03-06-2025 passed in O.S.No.131 of 2014 on the file of learned District Munsif Court, Vadipatti and allow the above civil revision petition.

ORDER

This Civil Revision Petition is filed to set aside the docket order dated 03-06-2025 passed in O.S.No.131 of 2014 on the file of learned District Munsif Court, Vadipatti.

In view of the limited relief that has been passed in this Civil Revision Petition, notice to the respondents is dispensed with.

3. The amended plaint had been retured on the premises that the same is not as per the order in CRP(MD)No.160 of 2020. A perusal of the said order would indicate that as against the order of amendment that has been partly ordered by the Court below, a revision had been filed by the first defendant, 2/5

which had been dismissed by this Court below uphelding the amendment ordered by the trial Court in I.A.No.2 of 2024. Therefore, there is no amendment that was permitted by this Court in CRP(MD)No.160 of 2020. In view of the same, the return that has been made by the Court below is without any basis.

4. Hence, the Court below is directed to carry out the amendment as per the order made in I.A.No.2 of 2024 as affirmed by this Court in CRP(MD)No. 160 of 2020. Necessary amendment shall be carried out as indicated above and thereafter, the trial shall be proceed with.

5. Accordingly, this Civil Revision Petition is allowed. No costs. Consequently, connected miscellaneous petition stands closed. 27.10.2025 NCC : yes / no Index : yes / no Internet : yes / no Note: Registry is directed to return the original amended plaint filed in this Civil Revision Petition to the petitioner.
