Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, to direct the second respondent to consider the claim of medical reimbursement under NHIS (National Health Insurance Scheme) 2015 (Co-operative Employee's Scheme) occurred on account of petitioner's son G.Ragulkavi's medical expenses for a sum of Rs.54,000/- within a time that may be fixed by this Court. O R D E R

This writ petition has been filed to direct the second respondent to consider the petitioner's claim of medical reimbursement of Rs.54,000/-.

2.The learned counsel for the petitioner would submit that the petitioner made a representation to the third respondent on 10.09.2018 for reimbursement of the medical claim about Rs.54,000/- under the National Health Insurance Scheme. Subsequently, the third respondent has forwarded his recommendation to the second respondent on 12.09.2018. Thereafter, there was no steps taken by the second respondent to reimburse the medical expenses of the petitioner. Therefore, the petitioner filed the present writ petition for appropriate directions.

3.The learned Government Advocate appearing for the respondents 1 to 3 would submit that the representation of the petitioner will be disposed of on merits and in accordance with law.

4.In view of the above, it appears that the petitioner made a representation before the third respondent on 10.09.2018 and subsequently, it was forwarded by the third respondent to the second respondent. Thereafter, the second respondent has not taken any action to dispose of the representation. Hence, this Court is constrained to pass the following order:- The second respondent is directed to forward his recommendation to the first respondent within a period of four weeks from the date of receipt of a copy of this order. Thereafter, the first respondent is directed to place the same before the District Level Empowered Committee to pass necessary orders for reimbursement of the medical expenses, within a period of four weeks from the date of receipt of the recommendation While considering the petitioner's application, the respondents shall take into consideration of the order passed by this Court in a batch of writ petitions in W.P.(MD).Nos.21950 etc., batch, dated 16.12.2020.

5.With the above directions, this Writ Petition is disposed of. No costs.
