Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.219 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/ accused, who apprehend arrest at the hands of the respondent Police for the offences punishable under Sections 147,148,294(b),324 of IPC and 1/3

section 3(1) of TNPPDL Act in Crime No.219 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner came to the shop of the defacto complainant and threatened the defacto complainant showing knife and broken the showcase glass by arual and also assaulted him with empty bottle. Hence, the complaint.

3. The learned counsel for the petitioner submitted that this the second anticipatory bail petition, earlier anticipatory bail Petition filed by the petitioner in Crl.OP(MD)No.11378 of 2023 was dismissed by this Court, on the ground that the petitioner is having four previous cases. He further submitted that this second anticipatory bail petition was filed mainly on the ground that the petitioner's name was not found in the FIR and based upon the confession statement of the coaccused, the petitioner's name was included in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate(Crl.Side) appearing for the respondent police submitted that without any valid ground, the present petition has been filed by the petitioner. He further submitted that the petitioner along with some other persons regularly involved this kind of activities in the near by areas.

5. Considering the fact that there is no change of circumstances and this Court 2/3

do not find any reason to entertain this petition. Hence, this Criminal Original Petition is dismissed.
