ORDER

This petition is filed seeking direction to the learned Judicial Magistrate cum Additional Mahila Court, Trichy to dispose of CC No.67 of 2017, within time frame and in accordance with law. 2.The petitioner is the defacto complainant in Crime No.6 of 2017 and after completion of investigation final report was filed before the Additional Mahila Court, Trichy and it was taken cognizance in CC No.67 of 2017 for the offences punishable under Sections 294(b), 498A and 506(i) IPC.

3.The learned counsel for the petitioner would submit that the first accused is the petitioner's husband and now he is in Dubai and he is not attending the Court regularly. Some of the accused persons are appearing and warrant has been issued against some accused persons. Since, some accused persons are absconding, there is no further progress.

4.It is seen that it is matrimonial dispute between the parties and the case is of the year 2017. Since the first accused is in Dubai, steps may be taken by the concerned Court to ensure his presence during the trial proceedings or the case may be split up against him and the learned Magistrate, Additional Mahila Court, Trichy shall proceed with the trial against the other accused persons. Crl.O.P.(MD)No.15156 of 2021 of the above courses. The entire process shall be completed within a period of five months from the date of receipt of a copy of this order. After completion of process, compliance report must be submitted to the Registry of this Court.

5.With the above directions, this Criminal Original Petition is disposed of.
