JUDGMENT

(By G.R.SWAMINATHAN, J.) Heard both sides.

2.The unsuccessful writ petitioner has filed this writ appeal. The appellant was an applicant for the post of Assistant Professor in the department of Art History. He was not selected and instead the fourth respondent was appointed in the said post. Challenging the same, the appellant filed W.P.(MD)No.11596 of 2014 and the same was dismissed vide order dated 27.11.2015. Questioning the same, this writ appeal has been filed.

3.We are not in a position to interfere with the order of the learned Single Judge for the simple reason that the appellant admittedly lacks NET qualification. Even though the appellant had obtained doctorate way back in the year 2000, NET has been made compulsory and since the appellant does not possess that qualification, he obviously could not have been appointed in the said post. On this sole ground, we confirm the order of the learned Single Judge.

4.It is stated that the appellant has the qualification in Art History. It appears that in no other university, the course in Art History is offered. The appellant is said to have served as guest faculty for more than four years. We, therefore, call upon the respondents to utilize the service of the appellant as and when the occasion arises. 5.With the aforesaid observation and direction, this writ appeal is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
