Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents 1 and 2 herein to implement the Circular already issued by the 1st respondent herein in Na.Ka.No.118/PuMaSu/2018 dated 09.07.2018 thereby preventing the 3rd respondent from illegally collecting excess charge of Rs.200/- for every transit receipt and forbearing the 3rd respondent from illegally collecting the amount over and above the GST Bill receipt for minerals for every load.

ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The writ on hand has been instituted to direct the respondents 1 and 2 to implement the Circular already issued by the first respondent in 2/6
Na.Ka.No.118/PuMaSu/2018 dated 09.07.2018, thereby preventing the third respondent from illegally collecting an excess charge of Rs.200/- for every transit receipt and to forbear the third respondent from illegally collecting the amount over and above the GST bill receipt for minerals for every load. 2.The learned counsel appearing for the petitioner submitted that the third respondent is illegally collecting a sum of Rs.200/- over and above the tax amount payable by the lorry owners.
3.In this regard, the District Collector, Kanyakumari District, convened a meeting and passed a resolution stating that no additional amount shall be collected by the third respondent or any other person. Despite the Circular and the resolution passed by the District Collector, the illegal collection of money is still going on, which is the grievance raised by the petitioner.
4.It is the duty of the District Collector to conduct surprise inspections and initiate appropriate action against the offenders. The 3/6
petitioner is at liberty to give a complaint to the District Collector. Even an information would be sufficient to the Collector to initiate appropriate action. All necessary steps are directed to be taken by the District Collector to prevent the illegal collection of money by the third respondent and in the event of any lapses, the authorities concerned shall be subjected to disciplinary proceedings.
5.With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
