To modify the condition No.(b) imposed upon the petitioner with regard to the deposit of sum in the order passed by this Court in Crl.OP(MD).No.929 of 2026 dated 23.02.2026.

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner seeking modification of the condition imposed on the petitioner in para No.6(b) of the order dated 23.02.2026 in Crl.O.P(MD).No.929 of 2026.

2. The learned counsel for the petitioner submitted that this Court, by order dated 23.02.2026, had granted anticipatory bail to the petitioner with certain conditions and one of the conditions is that the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.77 of 2026 before the Judicial Magistrate No.II, Madurai at the time of producing sureties. Further, the petitioner was directed to deposit another Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.77 of 2026 before the Judicial Magistrate No.II, Madurai, within a period of three months from the date of surety. He further submitted that due to financial incapacity, the petitioner was unable to arrange the said sum and thereby, she could not comply with the said condition. Hence, the learned counsel prays to modify the aforesaid condition for grant of anticipatory bail.

3. The learned counsel for the intervenor/defacto complainant has vehemently opposed for modification of the said condition.

4. On perusal of the order passed by this Court dated 23.02.2026, it reveals that the case relates to misappropriation of a sum of Rs.2,00,000/- and only after taking note of the fact that the petitioner is ready and willing to

deposit some amount to the credit of crime number, this Court granted anticipatory bail to the petitioner. However, the petitioner has not complied with the same and she now seeks to modify the said condition. Hence, this Court is not inclined to modify the conditions imposed on the petitioner in Crl.O.P.(MD).No.929 of 2026 dated 23.02.2026.

5. Accordingly, this Criminal Miscellaneous Petition stands dismissed. 29-06-2026 Lm To 1.The Inspector of Police, Thallakulam Police Station, Madurai City.
