Heard the learned counsel on either side.
2. The petitioner wants this Court to restrain the respondents from constructing any godown in the petition mentioned survey number. 2/4
3. When the matter was taken up for hearing, the learned Special Government Pleader produced the relevant records. As per entries in 'A register', Survey No.193/1, Kathirnayakanpatti was classified as "tpehafh; Nfhtpy;", whereas Survey No.193/2 has been classified as "Nkw;F jh;kd; Fsk;". It is made clear that no construction will come up on the water body. The District Collector, Dindigul had made a categorical statement in his proceedings dated 03.04.202 that even though this survey number has been classified as Vinayagar Temple, on ground, no such religious structure is in existence. We are also satisfied that the land has been re-classified only for public purpose. Interference is not warranted.
4. The Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
